                            <div align="justify">Sharp differences between Government representatives and civil society members in the Lokpal drafting committee came to the fore over basic issues such as the structural set-up of Lokpal, maximum punishment for corruption and graded punishment for culprits, during the fourth meeting of the panel here on Monday.<br /><br />However, Union Minister and panel member Kapil Sibal said that there was consensus on &quot;almost half of the&quot; 40 points brought to the table by Anna Hazare's five-member team. The minister said that there was an agreement in the meeting that the Lokpal will have power to look into any matter of corruption against public servants.<br /><br />With agreement on nearly 50% of the basic principles, the committee decided to direct the legislative department to begin drafting the Lokpal Bill. The main difference that came in the meeting was the structure of Lokpal as an institution.<br /><br />Civil society members have proposed that Lokpal should be a 11-member body with quasi-judicial powers, which would operate through officers under it. These officers would be designated authorities under the Lokpal Act and would have quasi-judicial authority. The Government, however, has conceived Lokpal as an 11-member body that would pass orders on all corruption issues.<br /><br />Civil society members pointed out that the structure suggested by the Government would make the workload unwieldy for Lokpal.<br /><br />A Hazare member of the panel said after the meeting, &quot;government has conceived Lokpal as an institution which would sit in benches. This body would be similar to Central Information Commission . The only difference would be that CIC is a quasijudicial appellate body which still has lesser workload than what we expect Lokpal to have. This is similar to saying that the CBDT chairman would decide on cases of all 3 crore taxpayers. Corruption cases would pile up and would take years to decide on.&quot;<br /><br />After a three-hour meeting, the ministers in the panel promised Hazare's representatives that they would get back to them on the matter. Another contentious issue was raising the maximum punishment. Civil society members have proposed that the maximum punishment for corruption cases be raised from seven years to life imprisonment. The Government feels it should be increased to a maximum of 10 years and not more.<br /><br />Civil society members, however, pointed out that the idea is to send a strong message to the people that India is serious about fighting corruption. The draft before the committee has also suggested a graded punishment system, the higher the status or rank of the accused the more the punishment.<br /><br />The Government has strongly objected to this. A Minister said, &quot;this sounds like an interesting and exciting principle but violates Right to Equality enshrined in our Constitution.&quot; Former Law Minister and panel member Shanti Bhushan argued that the suggestion did not infringe on individual's right to equality but was based on class system which has constitutional sanction as our system approves of quota for Scheduled Caste and Tribes.<br /><br />Bringing the higher judiciary and the Prime Minister within the ambit of the Lokpal are still sticking points and discussion on the same is expected to be taken up at the next meeting scheduled on May 30.<br /><br />The committee agreed to hold weekly meetings to meet the June 30 deadline for finalising the draft Lokpal Bill. Sibal expressed confidence that draft Lokpal Bill would be ready by June 30, as announced in a government notification, in time for introduction in the monsoon session of Parliament. <br /></div>

                            <div align="justify">Sharp differences between Government representatives and civil society members in the Lokpal drafting committee came to the fore over basic issues such as the structural set-up of Lokpal, maximum punishment for corruption and graded punishment for culprits, during the fourth meeting of the panel here on Monday.<br /><br />However, Union Minister and panel member Kapil Sibal said that there was consensus on &quot;almost half of the&quot; 40 points brought to the table by Anna Hazare's five-member team. The minister said that there was an agreement in the meeting that the Lokpal will have power to look into any matter of corruption against public servants.<br /><br />With agreement on nearly 50% of the basic principles, the committee decided to direct the legislative department to begin drafting the Lokpal Bill. The main difference that came in the meeting was the structure of Lokpal as an institution.<br /><br />Civil society members have proposed that Lokpal should be a 11-member body with quasi-judicial powers, which would operate through officers under it. These officers would be designated authorities under the Lokpal Act and would have quasi-judicial authority. The Government, however, has conceived Lokpal as an 11-member body that would pass orders on all corruption issues.<br /><br />Civil society members pointed out that the structure suggested by the Government would make the workload unwieldy for Lokpal.<br /><br />A Hazare member of the panel said after the meeting, &quot;government has conceived Lokpal as an institution which would sit in benches. This body would be similar to Central Information Commission . The only difference would be that CIC is a quasijudicial appellate body which still has lesser workload than what we expect Lokpal to have. This is similar to saying that the CBDT chairman would decide on cases of all 3 crore taxpayers. Corruption cases would pile up and would take years to decide on.&quot;<br /><br />After a three-hour meeting, the ministers in the panel promised Hazare's representatives that they would get back to them on the matter. Another contentious issue was raising the maximum punishment. Civil society members have proposed that the maximum punishment for corruption cases be raised from seven years to life imprisonment. The Government feels it should be increased to a maximum of 10 years and not more.<br /><br />Civil society members, however, pointed out that the idea is to send a strong message to the people that India is serious about fighting corruption. The draft before the committee has also suggested a graded punishment system, the higher the status or rank of the accused the more the punishment.<br /><br />The Government has strongly objected to this. A Minister said, &quot;this sounds like an interesting and exciting principle but violates Right to Equality enshrined in our Constitution.&quot; Former Law Minister and panel member Shanti Bhushan argued that the suggestion did not infringe on individual's right to equality but was based on class system which has constitutional sanction as our system approves of quota for Scheduled Caste and Tribes.<br /><br />Bringing the higher judiciary and the Prime Minister within the ambit of the Lokpal are still sticking points and discussion on the same is expected to be taken up at the next meeting scheduled on May 30.<br /><br />The committee agreed to hold weekly meetings to meet the June 30 deadline for finalising the draft Lokpal Bill. Sibal expressed confidence that draft Lokpal Bill would be ready by June 30, as announced in a government notification, in time for introduction in the monsoon session of Parliament. <br /></div>

                            <div align="justify">Sharp differences between Government representatives and civil society members in the Lokpal drafting committee came to the fore over basic issues such as the structural set-up of Lokpal, maximum punishment for corruption and graded punishment for culprits, during the fourth meeting of the panel here on Monday.<br /><br />However, Union Minister and panel member Kapil Sibal said that there was consensus on &quot;almost half of the&quot; 40 points brought to the table by Anna Hazare's five-member team. The minister said that there was an agreement in the meeting that the Lokpal will have power to look into any matter of corruption against public servants.<br /><br />With agreement on nearly 50% of the basic principles, the committee decided to direct the legislative department to begin drafting the Lokpal Bill. The main difference that came in the meeting was the structure of Lokpal as an institution.<br /><br />Civil society members have proposed that Lokpal should be a 11-member body with quasi-judicial powers, which would operate through officers under it. These officers would be designated authorities under the Lokpal Act and would have quasi-judicial authority. The Government, however, has conceived Lokpal as an 11-member body that would pass orders on all corruption issues.<br /><br />Civil society members pointed out that the structure suggested by the Government would make the workload unwieldy for Lokpal.<br /><br />A Hazare member of the panel said after the meeting, &quot;government has conceived Lokpal as an institution which would sit in benches. This body would be similar to Central Information Commission . The only difference would be that CIC is a quasijudicial appellate body which still has lesser workload than what we expect Lokpal to have. This is similar to saying that the CBDT chairman would decide on cases of all 3 crore taxpayers. Corruption cases would pile up and would take years to decide on.&quot;<br /><br />After a three-hour meeting, the ministers in the panel promised Hazare's representatives that they would get back to them on the matter. Another contentious issue was raising the maximum punishment. Civil society members have proposed that the maximum punishment for corruption cases be raised from seven years to life imprisonment. The Government feels it should be increased to a maximum of 10 years and not more.<br /><br />Civil society members, however, pointed out that the idea is to send a strong message to the people that India is serious about fighting corruption. The draft before the committee has also suggested a graded punishment system, the higher the status or rank of the accused the more the punishment.<br /><br />The Government has strongly objected to this. A Minister said, &quot;this sounds like an interesting and exciting principle but violates Right to Equality enshrined in our Constitution.&quot; Former Law Minister and panel member Shanti Bhushan argued that the suggestion did not infringe on individual's right to equality but was based on class system which has constitutional sanction as our system approves of quota for Scheduled Caste and Tribes.<br /><br />Bringing the higher judiciary and the Prime Minister within the ambit of the Lokpal are still sticking points and discussion on the same is expected to be taken up at the next meeting scheduled on May 30.<br /><br />The committee agreed to hold weekly meetings to meet the June 30 deadline for finalising the draft Lokpal Bill. Sibal expressed confidence that draft Lokpal Bill would be ready by June 30, as announced in a government notification, in time for introduction in the monsoon session of Parliament. <br /></div>

Govt disagrees on judicial powers of Lokpal; drafting of Bill begins by Nidhi Sharma

Sharp differences between Government representatives and civil society members in the Lokpal drafting committee came to the fore over basic issues such as the structural set-up of Lokpal, maximum punishment for corruption and graded punishment for culprits, during the fourth meeting of the panel here on Monday. However, Union Minister and panel member Kapil Sibal said that there was consensus on "almost half of the" 40 points brought to the table by Anna Hazare's five-member team. The minister said that there was an agreement in the meeting that the Lokpal will have power to look into any matter of corruption against public servants. With agreement on nearly 50% of the basic principles, the committee decided to direct the legislative department to begin drafting the Lokpal Bill. The main difference that came in the meeting was the structure of Lokpal as an institution. Civil society members have proposed that Lokpal should be a 11-member body with quasi-judicial powers, which would operate through officers under it. These officers would be designated authorities under the Lokpal Act and would have quasi-judicial authority. The Government, however, has conceived Lokpal as an 11-member body that would pass orders on all corruption issues. Civil society members pointed out that the structure suggested by the Government would make the workload unwieldy for Lokpal. A Hazare member of the panel said after the meeting, "government has conceived Lokpal as an institution which would sit in benches. This body would be similar to Central Information Commission . The only difference would be that CIC is a quasijudicial appellate body which still has lesser workload than what we expect Lokpal to have. This is similar to saying that the CBDT chairman would decide on cases of all 3 crore taxpayers. Corruption cases would pile up and would take years to decide on." After a three-hour meeting, the ministers in the panel promised Hazare's representatives that they would get back to them on the matter. Another contentious issue was raising the maximum punishment. Civil society members have proposed that the maximum punishment for corruption cases be raised from seven years to life imprisonment. The Government feels it should be increased to a maximum of 10 years and not more. Civil society members, however, pointed out that the idea is to send a strong message to the people that India is serious about fighting corruption. The draft before the committee has also suggested a graded punishment system, the higher the status or rank of the accused the more the punishment. The Government has strongly objected to this. A Minister said, "this sounds like an interesting and exciting principle but violates Right to Equality enshrined in our Constitution." Former Law Minister and panel member Shanti Bhushan argued that the suggestion did not infringe on individual's right to equality but was based on class system which has constitutional sanction as our system approves of quota for Scheduled Caste and Tribes. Bringing the higher judiciary and the Prime Minister within the ambit of the Lokpal are still sticking points and discussion on the same is expected to be taken up at the next meeting scheduled on May 30. The committee agreed to hold weekly meetings to meet the June 30 deadline for finalising the draft Lokpal Bill. Sibal expressed confidence that draft Lokpal Bill would be ready by June 30, as announced in a government notification, in time for introduction in the monsoon session of Parliament.
