Greater Noida land acquisition: Court scraps UP order

The Allahabad high court on Monday scrapped the acquisition of 170 hectares of land in Gulistanpur village of Gautam Budh Nagar in Greater Noida. The bench of Justice Sunil Ambwani and Justice K N Pandey quashed a UP government notification citing the urgency clause for planned industrial development in Gulistanpur village.

This is the third time this month that the high court has cancelled land acquisitions made by the UP government by invoking the urgency clause. On May 12 and 14, the court struck down UP government's acquisition in Saberi and Surakpur villages of Gautam Budh Nagar district.

The urgency clause empowers the government to acquire land for public purposes without inviting objections from farmers. Land had been acquired in February 2008, and 656 farmers were promised Rs 132 crore. However, some affected farmers had petitioned the high court in March 2008, challenging the clause. The acquisition was cancelled on Monday after the Greater Noida Authority failed to prove that any industrial work had begun on the land.

Allowing the writ petitions, the high court said the notification was quashed for those who had not taken compensation. However, it would be open for those who received compensation to approach the government under Section 48(1) of the Land Acquisition Act for release of their land.

Additional advocate general Zafar Naiyer, who appeared for the state, pleaded that about 70% farmers had received compensation for their land.
