HC issues non-bailable warrant against 3 dozen babus for contempt -Ravi Singh Sisodiya

LUCKNOW: A Lucknow bench of high court on Wednesday issued non-bailable warrants against three dozen state government officials for non-compliance of the court's orders. The state bureaucracy faced the ire of the bench for the second consecutive day for failing to carry out its orders within stipulated time despite being served contempt notices. The list of these officials includes Lucknow's DM Arurag Yadav and DIG Navniet Sikera.

Justice Sudhir Agarwal expressed surprise that whichever file he picked up for hearing, it showed that the government officials audaciously flouted orders of various HC benches. It directed the chief judicial magistrates concerned to ensure compliance of the NBWs and produce erring officials in the court in custody on the date of hearing.

The list of officials included principal secretary, transport, BS Bhullar; principal secretary, rural development, Rajiv Kumar; former director general of police, Atul Kumar; inspector general of prisons, Rajesh Pratap Singh; deputy inspector general of police, Lucknow range, Navniet Sikera; joint director, education, Prabha Tripathi; transport commissioner Rajnish Gupta, Lucknow DM Anurag Yadav and a number of other top officials. The NBWs were issued in different contempt matters. These officials had not turn up to apprise the court whether the order had been complied with or not despite issuance of contempt notices. The court also directed the officials to comply the orders by next date.

Meanwhile, principal secretary, home, RM Srivastava, got relief on technical grounds, but the court took Ambedkarnagar's Basic Shiksha Adhikari Dal Singar Yadav into its custody and kept him in detention at the high court's police outpost for the entire day on Wednesday. He was allowed to go in the evening after furnishing a surety of Rs 25,000 with the directions to appear on the next date for further proceedings of the contempt of court.

Srivastava appeared before Justice Satish Chandra, who had put him in court's custody on Tuesday for not complying with an order for providing security to former minister Ramveer Upadhayay. Srivastava was allowed to go on Tuesday evening after he furnished an unconditional apology. He was directed by the court to appear on Wednesday morning along with his explanation. However, on Wednesday, on behalf of Srivastava a request was made to defer the hearing as he has filed a special appeal against contempt proceedings before a division bench. Later, around 1 pm, the bench comprising Justice Umanath Singh and Justice Mahendra Dayal gave a stay on Justice Chandra's proceedings while reserving the verdict.

On the other hand, BSA Ambedkarnagar Dal Singar Yadav was detained by the court as he failed to clear the dues of a sweeper posted in Ranimau Parishadi School, Ambedkarnagar, within time. He has also been summoned in another contempt matter on Thursday.
