HC transfers Virar RTI activist murder investigation to CID -Mustafa Plumber

The Bombay High Court has transferred the investigation into the killing of RTI activist Premkant Jha to the State Criminal Investigation Department (CID) after the local police failed to make any headway in the case.

Jha was shot dead in broad daylight in Virar on February 24, 2012. He was an RTI activist as well as the national level public relations officer of the Bhrashtachar Atyachar Virodhi Samiti. At first a mistaken case of accidental death was registered at the Virar police station, but later amended to a murder charge after receiving the autopsy report.

The RTI activist was shot by unidentified assailants when he was returning to his house on his motorcycle. The investigations were initially conducted by the Virar police station which later transferred it to the anti-human trafficking cell which also failed to probe the case properly. Since the investigations were heading nowhere, Mihir Jha, the deceased’s son moved the Bombay High Court seeking to transfer the investigations to an independent agency like the Central Bureau of Investigations (CBI).

A division bench of Justice PV Hardas and Justice Abhay Thipsay were informed that after the investigations were transferred to the special cell it was returned back to the local police station on January 3, 2013. The court said, “From the recent report of the police it is clear that it is groping in dark and it is extremely unlikely that headway will be made in the investigations.”

The court thus transferred the investigations to the State CID (Crime) and noted, “We expect and hope that CID will make some headway in the case.” The court has thus kept the petition pending and directed the CID to file their probe report after four weeks.
