In new Bill, Govt looks at annuity for farmers as in Haryana and UP by Swaraj Thapa

The government is ready with a revised Land Acquisition (Amendment) Bill 2010 that has kept the interest of farmers and landowners in mind, officials today asserted in the backdrop of Rahul and Sonia Gandhi’s strong pitch favouring a pro-farmer policy on the contentious issue.

Officials in the Rural Development Ministry today hinted that the revised Bill may contain provisions that will allow for better and adequate compensation for those whose land is acquired by the government for development. New clauses that allow for payment of annuity for those dispossessed of land, along the lines of the Haryana land acquisition policy, are being actively considered for inclusion in the revised Bill, the officials said.

Besides the lumpsum payment as compensation, Haryana has a scheme that allows annuity payment of Rs 15,000 for 33 years with a Rs 500 increase every year — last week, UP Chief Minister Mayawati, unveiling a new rehabilitation plan for farmers whose land is acquired, said they will be paid, in addition to compensation, annuity of Rs 20,000 per acre for 33 years with an increase of Rs 600 every year.

The earlier 2007 land acquisition Bill, which was introduced in February 2009 and lapsed after the 14th Lok Sabha ended, did not contain such annuity provisions.

A senior UPA minister also indicated that provisions relating to acquisition of fertile land could be made more stringent in the revised Bill — possibly restricting them only to the areas of strategic and major infrastructure projects like power and roads.

Congress president Sonia Gandhi yesterday praised the Haryana model on land acquisition, saying other states should emulate it. Inaugurating the Dadri Thermal power project Stage II, she cautioned that land acquisition should not result in loss of fertile and productive agricultural land. “If farmers are deprived of their land-based livelihood out of necessity, they must be provided with adequate compensation and alternative occupations,” she said.

Her son and party general secretary Rahul Gandhi last month set the tone on the issue when he met Prime Minister Manmohan Singh and urged him to get the legislation on land acquisition going. Ahead of his meeting with the Prime Minister, Rahul had visited Aligarh where he told protesting farmers that he would take up their concerns at the appropriate level. His also visited the Niyamgiri hills in Orissa where Vedanta lost out on a major bauxite mining project recently.

Officials, though, indicated that one of controversial clauses relating to acquisition of land for private developers could be revisited in the light of strong opposition from political quarters. The earlier 2007 Bill provides for remaining 30 per cent of land to be acquired by the state if the private developer has already acquired 70 per cent of the land.

Trinamool Congress chief Mamata Banerjee has strong objections to the clause with the contention that government should not at all assist private developers in land acquisition. “This clause can be increased in a manner that 100 per cent acquisition has to be done by the developer or at a 90:10 ratio, depending on the political will and negotiations,” a senior official said.
