IPR policy in the works

New Delhi: The government plans to come out with a policy on intellectual property rights (IPR) within a few months, with developed nations such as the US and the EU raising concerns over the country's patent rules.

"India does not have an IPR policy. This is the first time we are coming out with a policy. IPR policy issues have been hanging fire for quite a long time," commerce and industry minister Nirmala Sitharaman said today.

She said her ministry would soon have a think-tank, which will enable it to handle the issues more firmly.

The policy will help to deal with issues being raised by the developed countries and protect India's interest on IPR-related matters.

"It will give direction in terms of protecting IPR of India on which several issues are there. With the US we have (certain) issues. India has become a brand in terms of pharma. We are very strong in IPR and we certainly want to protect our interest. Developed nations are picking holes in India's IPR laws because it does not have any policy," Sitharaman said.

The ongoing tussle with the US on intellectual property rights and laws has affected the pharma and IT sectors. In April, the US brought out the Special 301 report that lists countries on the extent to which they met certain patent standards, which may be more stringent than the WTO obligation.

The report classified India as a "priority watch list country". It highlights Washington's concerns related to various provisions of the Indian patent law, the grant of compulsory licence and the inclusion of a statement relating to the licencing of green technologies in India's manufacturing policy. The Indian government and industry maintain that the US report is shaped by inputs by the American industry on their perception of the level of protection provided by India to intellectual properties.

Sitharaman said the draft policy would be put out soon for public comment and it might take about six months to prepare the policy.

On the proposed think-tank on IPR, Sitharaman said, "We are going to have the benefit of experts, who will constantly keep us informed about developments on international IPR issues and flag off concerns."
