Jairam Ramesh rules out any significant changes in land acquisition bill

Rural development minister Jairam Ramesh has ruled out any significant changes in the land acquisition bill. "There will be no significant changes to the bill. Just like the Supreme Court has ruled that there is a basic structure to the Constitution, there is a basic structure to the bill that cannot and will not be tampered with," Ramesh told reporters here on Monday.

The bill, which was taken up for Cabinet approval last week, was referred to a group of ministers after five senior ministers - Kamal Nath, Veerappa Moily, Anand Sharma, CP Joshi and Ajit Singh - said that the proposed law, in its current form, would come in the way of industrialisation and urbanisation.

Ramesh, who described the bill as a 'political pledge of the Congress' insisted that it will be introduced in the winter session of Parliament. "The ministry has tempered the political agenda with economic realities," Ramesh said.

Sections of Congress see the land bill as central to the party's 'socially progressive' image. The land bill has been touted as providing a balance between needs of industry for smoother land acquisition and interests of landholders. Based on stakeholder feedback and standing committee recommendations, the ministry had amended the bill. According to the rural development ministry, some changes - like making the law prospective, reducing the consent requirement to 80% landowners - are geared to address concerns of industry and investors. States too have been given a greater leeway in deciding threshold for rehabilitation and resettlement package in case of private purchase.

Ramesh said that the prime minister had some concerns about over-bureaucratisation and would like to ensure that the scope for corruption is restricted completely. "The prime minister wants the bill to ensure that delays are ruthlessly eliminated and all discretionary powers removed. He also wants the bill to have no additional bureaucratic layers," Ramesh said. These concerns have been addressed in the land bill.

Making it clear that there would be no changes in the basic structure of the bill, Ramesh stressed that provisions on the rehabilitation and resettlement provisions, or the requirement to undertake a social impact assessment ahead of the acquisition would remain unchanged.

The minister specifically ruled out exempting the SEZ Act from adhering to the compensation and resettlement and rehabilitation provision of the bill. Commerce and industry minister Anand Sharma has already registered his opposition to this proposal.

Anand Sharma had also raised the issue of easing acquisitions for the National Manufacturing and Industrial Zones and the Delhi-Mumbai Industrial Corridor. Industry bodies have suggested that acquisitions for both these be treated as public purpose.
