The Supreme Court hopes the intractable land disputes of Singur and Nandigram will get resolved after the Bengal elections.

“Wait until the elections,” Justices R.V. Raveendran and A.K. Patnaik said today, giving a July hearing date on a slew of petitions demanding the land acquired for the Tata Motors plant in Singur be returned to farmers.

“We may not have the problem then (after the elections),” Justice Raveendran, the senior judge on the bench, said, to laughter. A July hearing means the court will hear the case after its summer recess.

The top court has adopted a wait-and-watch approach ever since Bengal went into poll mode. It has repeatedly adjourned the Nandigram firing case on the same grounds. It did so the last time on April 27.

In that case, the state’s counsel, K.K. Venugopal, alleged the Opposition had fanned the protests against the takeover of land for the proposed chemical hub.

The apex court has allowed the CBI to complete its probe into the officers responsible for the firing but stayed their prosecution.

The West Bengal Association for Democratic Rights, whose case is being argued by Trinamul MP and lawyer Kalyan Bandhopadhyay, has been pushing for lifting the stay on the prosecution.

During today’s hearing, Prashant Bhushan, the lawyer for the Singur farmers, pressed for the return of the land. “It is not enough that the Tatas have left. The land acquisition has to be rescinded,” he said.

But tackling land rows is a tough task. The court will have to examine the antiquated Land Acquisition Act of 1894. In several earlier judgments, it has laid down the principles governing land acquisition — all of which go against farmers.

In one ruling, it said the land acquired for a public purpose and not used for it for some reason couldn’t be given back. The state can use it for some other public purpose.

Hearing the Singur plea could mean the court having to revisit all the judgments it has passed in the past.
