Legal settlements hit record in Tamil Nadu by A Subramani

At a time when ordinary money suits and cheque bounce cases are taking years for settlement, lok adalats in Tamil Nadu have set a new record this year by quietly disposing of more than 33,000 cases involving Rs 247 crore upto October 2010.

The Tamil Nadu State Legal Services Authority (TNSLSA), headed by its executive chairman justice Elipe Dharma Rao, conducted a total of 4,579 lok adalats and heard more than 58,000 cases during the January-October 10-month period.

The Authority experimented with the cluster disposal system, wherein cases of a particular nature or concerning a specific financial institution or bank were bunched together and referred to mega adalats for settlements. Cases settled in lok adalats are final in nature, and no court, including the Supreme Court, can interfere with or reopen the settlement.

With cases worth Rs 247.57 crore being disposed of in the 10-month period, the value of the settlements was much more than those achieved in any of the preceding 11 years.

For instance, in 2009, a total of 5,464 lok adalats were held. Over 50,000 cases were settled and the money claimed amounted to Rs 191 crore. Of them, 5,035 were motor accident claims cases involving Rs 60.3 crore. In 2008, the Authority had conducted 4,849 lok adalats, and settled 46,547 cases. The total amount collected or settled was more than Rs 227 crore. One of the reasons for the surge in settlements this year was the increase in mega adalats.

One of the reasons being cited for the rise in settlements in this year was the increase in mega adalats.

"This year we conducted a total of 38 mega adalats and they disposed of nearly 20,000 cases," said a TNSLSA official. The settlements done in mega adalats alone account for nearly Rs 17 crore, he added. Similarly, the district authority and the High Court Legal Services Committee too conducted mega lok adalats and settled a total of 18,869 cases in 2010. The settlements involved over Rs 11 crore.

On January 6, 2010 cases concerning the Central Bank of India alone were listed for hearing. A total of 226 cases, out of the 1,430 listed cases, were amicably settled and over Rs 11.2 crore was realised in the process. After that, four more similar exclusive adalats for the State Bank of India, ICICI Bank, HDFC Bank and Deutsch Bank were conducted and more than 550 cases were settled by October 2010.

For the first time, a special legal aid clinic was also held for the welfare of slum-dwellers, to mark the birth anniversary of Dr BR Ambedkar on April 14, 2010.

On the legal literacy and awareness front, the Authority conducted a first ever seminar on legal issues concerning the transgender community. It also conducted programmes on adoption, children rights, prisoner rights, human trafficking and exploitation. It opened 11 new legal aid clinics in Tamil Nadu, which already had five such centres.
