The dissent-riven report of the parliamentary standing committee on the Lokpal bill is set to recommend exclusion of the Prime Minister from the proposed anti-graft authority’s ambit, a decision bound to intensify the government’s tussle with Team Anna.

No consensus could be reached on the question of the Prime Minister’s inclusion at the last meeting of the committee. While most members felt that the country’s top executive office should not be subjected to any additional pressure, those from the BJP and the Left disagreed.

The Congress members, helped by those from the Samajwadi Party, BSP, RJD and the AIADMK, overruled the seven BJP members and one from the CPM to keep the Prime Minister out of the Lokpal’s purview.

There was division even among those who opposed the inclusion of the Prime Minister’s Office. While some felt it should not be included at all, others said it could be included with strong safeguards or after the Prime Minister demits office.

Everybody, however, agreed to make the Lokpal a constitutional body, a suggestion given by Rahul Gandhi.

The committee has agreed to include group B and C employees within the Lokpal’s purview, a demand put forward by Anna Hazare and his group.

The BJP dissented as the committee did not favour Hazare’s demand for inclusion of a citizen’s charter and the grievance redress bill in the proposed Lokpal law. The BJP also wanted a provision to protect whistleblowers in the Lokpal bill, echoing Hazare’s demand.

Committee chairman Abhishek Singhvi and the others favoured separate bills for these issues, as proposed by the government.

There was also dispute on the merger of the CBI’s anti-corruption wing with the Lokpal. The BJP wanted the Lokpal chairperson to be part of the selection panel for CBI director to dilute the impression that the premier investigating agency was a tool in the hands of the government.

The others didn’t agree, saying it would concentrate enormous powers in the hands of one authority.

On the question of removing the Lokpal, the BJP opposed the suggestion that the President should have the last word. It wanted the Supreme Court chief justice to have the last word as the President often goes by the advice of the government.

The recommendations of the committee are not binding on the government.
