NEW DELHI: While the Central Vigilance Commission's (CVC) role as the prime anti-corruption and vigilance agency against Group A civil servants and equivalent will continue; its overall workload could go up in the lokpal era.

There are several noticeable similarities in both the Lokpal Bill and the Central Vigilance Commission Act in their role as anti-corruption agencies, but there are also discernible differences between the two.

A false complaint filed with lokpal could attract a fine of Rs 1 lakh or jail term, while CVC doesn't have such a harsh approach towards false complaints. Besides, lokpal cannot enquire into complaints that are older than seven years from the time of an alleged irregularity, whereas the CVC Act does not have any such cut-offs.

According to an early assessment by officials, the workload of CVC would go up, with lokpal referring complaints against even Group B, C and D officials to it. The CVC will continue to investigate complaints against Group A officials independently as well as on reference from lokpal.

Officials point out that the CVC will continue to have superintendence over the CBI, supervise vigilance administration in ministries and departments, as well as give vigilance clearance for senior appointments.

For people wanting to lodge complaints against group A category officials and equivalent, numbering around 150,000, they would now have two options: Either to go to CVC or lokpal. For complaints against Group B, C and D, CVC has no jurisdiction while lokpal will admit complaints against all classes of government employees.

There are about 65 lakh central government employees, other than military. So all of them would in effect be covered by the Lokpal Act, which also covers the Prime Minister, ministers etc. lokpal will also have powers to inquire NGOs receiving government funding or foreign donations above Rs 10 lakh per year.

The CVC would continue to head the selection committee to shortlist the CBI chief, and will also shortlist the newly proposed director of prosecution for the investigating agency.
