Maharashtra government junks order on sedition -Prafulla Marpakwar

MUMBAI: Alarmed by stringent criticism of his government, chief minister Devendra Fadnavis on Saturday said the controversial order on sedition charges will be scrapped as early as possible.

"We are scrapping the controversial circular. We do not require it. We will inform the Bombay high court accordingly," Fadnavis told TOI.

In response to a petition filed by cartoonist Aseem Trivedi and a public interest litigation by Narendra Sharma, a division bench of the Bombay high court had, on September 23, restrained the state government from acting on the August 27 circular, which gave enormous powers to law-enforcement agencies. Trivedi's contention was that the circular was unconstitutional and violated an individual's fundamental rights.

Then, the government pleader had told the high court that either the circular will be withdrawn or a fresh one issued.

Cartoonist Trivedi was arrested on September 8, 2012, under Section of 124A (sedition) of the Indian Penal Code on allegations that his cartoon on a website was against the National Anthem and Parliament. Law-enforcement agencies had said the cartoon's contents attracted provisions of Section 124A.

According to the August 27 order, any individual who makes allegations against a public personality or a politician is liable to be punished under Section 124A of IPC. It was alleged that the possibility of gross misuse of the new order is not ruled out and it should be scrapped under such circumstances. "The order gave police all powers to act against those critical of the state or the central government," a bureaucrat said.

The bureaucrat expressed shock over Fadnavis' statement that he had never signed the proposal for issuing any Draconian law. "Fadnavis' statement is quite surprising. If such an important order is issued without the knowledge of the CM, the officer who drafted the order should be taken to task. I feel a high-level probe should be conducted to find how such a circular was issued without application of mind," he said.

Ever since the circular was issued, Fadnavis was at the receiving end for encroaching on the fundamental rights of common people.
