Make the CBI accountable also to the court, a Parliament committee and NHRC

The Supreme Court has pulled up the CBI for misleading it on whether the agency had shared its status report with the government. Indeed, there can be no excuse for misrepresenting facts to the apex court. The Additional Solicitor General who told the court something that he knew to his personal knowledge to be false and the Attorney General who did not make amends must both go.

The government also owes the public and the courts an explanation as to why it kept quiet about both the meeting of the law minister with the CBI director and of misrepresentation of facts before the court.

The law minister's meeting did not take place in any secret hideout in the middle of the night when no one was watching. It was a meeting at the ministry. What the minister wanted to do with the draft report has been reported to the courts. Both the meeting and the subsequent reporting to the court are in order.

There can be no case for an agency like the CBI not to be accountable to the elected government of the land. To make it independent of the government is to run the risk of creating a rogue agency that abuses its powers of surveillance, investigation and prosecution or non-prosecution.

That the court expected such autonomy seems to be at odds with the requirements of democracy. What needs to happen is to make the CBI accountable also to the court, a committee of Parliament and the National Human Rights Commission. Such variegated oversight would ensure professionalism and that no part of the government tries to bend the agency's working.

The coal scam, let us be clear, was a scam of the entire political class, not particularly of the government at the Centre. The government of every state with mines opposed auctions and took part in the screening committee process that allocated the mines. The way out is to scrap state monopoly in coal and auction merchant mining rights. All captive mines bestow undue benefit on someone - there are no lily-white captive coal mines.
