Malnourished baby dead, parents booked 6 months later for ‘negligence’ by Milind Ghatwai

Six months after she died, police in Bhopal have acted on the death of a two-year-old, malnourished girl. They have booked her parents, charging them with “causing death by negligence”.

Activists say that this is perhaps the first instance in India where parents have been blamed for death caused by malnourishment.

Adviser to Supreme Court commissioners in the right to food case Sachin Jain said the administration always tried to push malnutrition deaths under the carpet and that this was a “dangerous trend”. “There are 10 lakh severely malnourished children in the state and each one of them is vulnerable to diseases. Will the government continue to book parents if some of them die?” he asked.

The police claim they filed a case six months after the girl’s death because they were seeking the opinion of doctors and waiting for a clearance from “above”.

The daughter of daily wagers Amarchand and Laxmi, Shalu was severely underweight when brought to Hamidia Hospital in Bhopal on June 15, and was declared dead on arrival. The couple, residents of Kalyanpur village on Bhopal’s outskirts, first took the child to the nearest anganwadi, then to a private clinic and, finally, to the government hospital.

The police registered a case under Section 304 of the IPC against the couple — which can get them two years in prison — only yesterday, saying they did not take care of their child. They conceded the child was malnourished, but said the couple lost time in seeking treatment from a quack.

Amarchand and Laxmi, who have three more children, the eldest being an eight-year-old girl, deny this. “Shalu was underweight and had high fever. Why would we have taken her to the anganwadi and then to Hamidia Hospital if we wanted to get rid of her?” they asked.

Amarchand alleged the police had asked for Rs 12,000 to “settle the case” and even taken Rs 5,000 that Amarchand had on him. Denying this, Head Constable Santosh Singh of Sukhi Sevania police station said the couple were “lying”.
