Nagaland prepares to implement Right to Education by Jan 2012 by Chizokho Vero

In keeping with the need for the successful implementation of the Right to Education (RTE) Act 2009 in Nagaland, enhancing the level of awareness, further discussion and to get well versed about the rules as enshrined in the Act has been strongly felt at a seminar held today with NGOs, organized by SCERT, Nagaland at DUDA Guest House.

Nagaland will also join the rest of the country in implementing RTE Act by January 2012.

In exercise of the powers conferred by section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (35 of 2009), the state government through Nagaland Gazette has already notified Nagaland Right of Children to Free and Compulsorily Education Rules, 2010 on March 21, 2011, which will come into force from the date of publication in the official gazette and shall be extended to the whole of Nagaland.

Commissioner & Secretary for School Education & SCERT Imkonglemba Ao, IAS said a collective responsibility is required and urged upon the state holding agency to put its best effort for effective implementation of RTE, which will be implemented in Nagaland by January 2012.
 
Stating that although the rules for the Act have been already framed and notified, he felt that there should be enough room for amendment, adding that one need to study well and give suggestion if any.

He asserted that the enactment of RTE Act has become like a solid rock and it will remain as a constitutional provision unlike other schemes that change from time to time.

Imkonglemba also stressed on the need to strengthen the level of Public Private Partnership (PPP) with private schools, adding that there is a room to work together. He said this while referring to private schools for non entitlement for RMSA, SSA scheme. He made the point clear that private schools are untitled for those schemes but there are also other facility “we need to work together.”

Replying to suggestion that a retired teacher, educationist or expert should be part of VEC, WEC etc., the Commissioner and Secretary said the school management committee will be amended shortly.

School Education director N. Khevito Sema also sought constructive suggestions from NGOs for proper execution of the Act so as to give justice to children.

Kevi Liegise, Joint Director RTE & Training SCERT said the Right to Children to free and compulsory education (RTE) Act, 2009, was indeed a bold and ground breaking move aimed at the realization of educational justice to all irrespective of many differences that exists in society.

“Justice and transparency are two keywords under this Act. It is therefore a noble initiative that deserves the support of all concerned,” he said in his keynote address at the seminar.

Stating that a large part of the Act are reaffirmation of crucial aspects of earlier educational policies, he however said, the Act also envisages many new and bold measures at elementary level such as non-detention, no expulsion, no board examination, free education even in private schools for the economically weaker section of society, admission according to age, special training and so on.”

Referring to free and compulsory elementary education, Liegise said every child from 6-14 years shall be provided with free and compulsorily elementary education upto Class VIII from 2012 onwards.

Free means there will be neither admission nor tuition fees for government schools and compulsory means all requisite conditions for educating every child should be made availed, he said and adding that concerned authorities, at all levels, state, district, village, school and partners must take all necessary measures to ensure this.

He stated that the out of school children (never enrolled and dropouts) will be admitted to Class levels appropriate to their age, adding that there will be special training to enable them to cope with the levels and processes of learning. This special training will be given by the school teachers or teachers especially appointed/engaged for this work based on material written for the purpose. It shall be conducted in the school premises or in safe residential areas. Apart from this, there shall be no private tuitions for both government and private schools.

On 25% free education in private schools, he said that 25% of total enrolment at entry level in private schools should belong to economically weak students whose parents’ income does not exceed Rs. 40,000 per year and disadvantaged children. For these children, the government will reimburse their fees at the rate of the government incurs on a student in government schools or actual school fee, whichever is less.

On non detention and CCE, Liegise told the seminar that no students shall be detained at any level till completion of class VIII and at the same time clarified that non detention does not mean no tests. In fact there shall be more tests and evaluation.

He said Continuous and Compressive Evaluation (CCE) should be strictly implemented to ensure that every student is fully prepared for the next class also that all round development is taking place.

There shall no longer be any board examinations at elementary level from 2012 onwards. Every student shall be given a certificate on completion of class VII, containing grades. Cumulative record will be carefully maintained for all students from Class A.

Under the Act, he said that there shall be no physical punishment or mental harassment, adding that discipline in the classroom shall be maintained through other means.

On teachers and student ratio, he said upto Class V, there should be one teacher for every 30 children. Even if students total is more than 200, ratio should be not exceed 1:40. For classes 6 to VIII, there should be atleast one teacher in every subject and keeping 1:35 teacher: pupil ratio. All teachers must be qualified and all untrained teacher must be trained within five years.
 
On school building, it will also ensure adequate number and properly maintained classrooms, separate toilets from boys and girls, drinking water facilities, kitchen for mid-day meal and barrier free access.
