Calcutta High Court today came down on the CID for its failure to track down all the accused in the Netai killings.

Nine persons were killed when alleged CPM activists fired on villagers from an armed party camp in Netai in West Midnapore on January 7.

Today, a division bench of Chief Justice J.N. Patel and Justice A.K. Roy criticised the state for not paying enough attention to the case. The court made the remark when the state failed to produce the case diary of the deaths.

“We are sorry to say that the state authorities are not attentive enough in this court. In our February 4 order, we had directed the state to produce the case diary before this court. But the authorities could not carry out the court’s order. Why?” the bench asked advocate-general Balai Ray.

In reply, Ray said two accused in the Netai case were arrested by the CID yesterday. “These two people will be produced before the trial court today. The case diary would have to be produced before the trial court. So we failed to bring the case diary today.”

But the reply did not satisfy the judges. They asked Ray: “Why don’t you make a duplicate of the case diary?”

The chief justice said the court on February 4 had directed the government to track down all the accused. “Since then, only two have been arrested. What about the others? Why is the CID not searching out the other four who are accused?” the court asked.

The government later produced a report on the progress of the CID investigation in a sealed cover and the judges refused to disclose its contents in the open court.

The court fixed February 18 for detailed hearing. It also asked Ray to produce the case diary on that day.

The Calcutta High Court Bar Association had moved a petition after the Netai incident in the second week of January demanding a CBI probe and compensation for family members of the dead and for those who were injured.

The court had awarded interim compensation but the matter relating to the handing over of the probe to the CBI is still under its consideration.

Duo in custody

Abani Singh and Ashwini Chalak, who had been arrested from Midnapore town by the CID for their alleged role in the Netai killings, were produced in Jhargram court today. They have been remanded in CID custody for 10 days.

Singh, the main accused in the case, is the CPM’s Lalgarh local committee member. Chalak is a branch committee member of the party.

While waiting to be taken to court, they were beaten up by some suspected Maoists who were also to be produced in the same court today.
