New law proposed to prevent unlawful practices in schools by Aarti Dhar

To protect the interests of students seeking admission, the Centre is planning a law to check unfair practices in schools, ranging from donations and nexus with coaching centres.

The proposed “The Prohibition of Unfair Practices in Schools and Intermediate Colleges Bill, 2011” aims at promoting transparency through mandatory self-disclosure in the prospectus and on the website, and provide adequate and accessible recourse for remedial action arising out of non-adherence to self-disclosed details and norms.

The law will provide for civil and criminal penalties and liabilities for violations and is substantially patterned on the Prohibition of Unfair Practices in Technical, Medical Educational Institutions and Universities Bill, 2011, which is awaiting Parliamentary clearance.

The draft of the bill that seeks to cover all private and government schools has an in-built safeguard against any “misuse of authority or unnecessary interference with the autonomy” of the institutions as it places the onus on educational institutions of any violations or conflict with the declarations made by the institutions themselves. This is intended to make the institutions assume greater responsibility in informing students seeking admission and other stakeholders about its standards of quality, teaching faculty, other facilities and infrastructure.

The new law will prohibit accepting any fee or charge by any institution without issuing receipt. It will ban donation/capitation fee sought either directly or indirectly by the institutions and provides for refunding of percentage of the fee deposited by the students if subsequently the student withdraws from the institution.

The Bill will come up for discussion at the Central Advisory of Education (CABE) next week — education being in the Concurrent List.

Safeguards will be built into the legislation so that there is no misuse of authority while imposing penalties of a civil nature or prosecution leading to punishment.

The step has been taken as some private school managements have been resorting to unfair practices, including demanding donations for securing admission, overcharging of fee, not issuing written receipts, non-refund of fees, not adhering to syllabus disclosed to public, admissions through non-transparent processes, the quality of education, teachers and infrastructure and misleading advertisements, and withholding certificates.

At present, the schools under the administrative control of Kendriya Vidyalaya Sangathan, Navodaya Vidyalayas and State governments, are governed by the rules framed by them.
