NHRC seeks more teeth, clashes with Centre, gets SC's support -Dhananjay Mahapatra

NEW DELHI: The Centre and National Human Rights Commission clashed in the Supreme Court on Wednesday over the panel's plea to make its recommendations in human rights violations cases, including those by the armed forces, binding on the Centre and state governments.

"Unless the recommendations of the human rights panel are given binding status, the whole exercise of conducting an inquiry or investigation by a body like NHRC would be nothing but a futile exercise and frustrate the statutory mandate for the human rights body to protect rights of citizens," senior advocate Gopal Subramaniam said while appearing for NHRC.

"It is therefore necessary that the orders and recommendations made by the Commission during and after inquiry may be given the status of being binding in nature unless the governments concerned challenged it in the high courts or the Supreme Court within 30 days from the recommendations," NHRC said.

NHRC's detailed submissions were handed over to a bench of Justices Madan B Lokur and U U Lalit by advocate Shobha. What promped attorney general Mukul Rohatgi to rally against NHRC's submission was the plea to give its powers full play even in human rights violation cases by the armed forces.
