NIA opposes Sadhvi's bail plea in Malegaon blasts case

National Investigation Agency (NIA) on Saturday opposed the bail plea of 2008 Malegaon blasts accused Sadhvi Pragyasingh Thakur on the grounds that “there is serious incriminating evidence against her.”

“There are reasonable grounds prima facie to believe that she is guilty of the offences which are levelled against her as contemplated under section 21(4) of MCOC [Maharashtra Control of Organised Crime] Act,” the NIA said in its reply filed before the special MCOCA court here.

The NIA has not yet filed a supplementary charge sheet in the 2008 Malegaon blasts case, after it took over the investigation from the Maharashtra Anti-Terrorism Squad (ATS). The ATS filed a charge sheet against the accused in 2009.

Toeing the line of investigation by the ATS, the NIA said in its reply that it was Sadhvi, a prime accused in the case, who arranged the meetings in which the other accused decided the strategy of the blasts. Citing incriminating evidence against her, the NIA also said that she took the responsibility of providing men for planting the bombs.

The detailed 74-page reply of the NIA has relied on the statements of at least 47 witnesses, confession statements of some of the accused, transcripts of SMSes, intercepted conversations of the accused, among other things.

The reply refuted the claim made by Sadhvi in her bail plea filed in November 2011 that there was no concrete evidence against her except the two-wheeler used for the blast, which she had sold in 2004. The reply said that the statements given by various witnesses revealed Sadhvi's complicity in the crime. It said that no case of parity is made out in the case.

The NIA said that Sadhvi had in fact asked co-accused Ramchandra Kalsangra why only a few people were killed in the blast which was carried out using her two-wheeler, an LML Freedom. It described the two wanted accused in the case, Ramchandra Dange and Sandeep Dange as her “henchmen”.

“In the present case, there is overwhelming evidence against the applicant accused Pragyasingh Thakur, for the offences punishable under the UAPA [Unlawful Activities (Prevention) Act] as well as for the offences punishable under… the MCOC Act 1999 and for offences under the IPC… There are circumstances to show that applicant accused Pragyasingh Thakur had conspired with the arrested and wanted accused for the commission of this offence.”

“The accused and others have aided and abetted the Organised Crime Syndicate and on behalf of the Organised Crime Syndicate have committed continuing unlawful activities by using violence and other unlawful means with the objective of gaining pecuniary benefits, undue economic and other advantages for themselves,” it stated, justifying the MCOCA charges against her and the other accused.

The hearing on the bail plea will begin on January 21.
