“Just as the civil society has been involved in the formulation of a Lokpal Bill, so should people's representatives be allowed to participate in framing a new, comprehensive law on Development Planning that includes resettlement and rehabilitation of those displaced by projects.”

To intensify stir

This is the demand of pradhans of several western Uttar Pradesh villages, who, along with along with representatives of the National Alliance of People's Movements (NAPM) spoke to journalists here on Thursday.

“Public purpose should be decided by the community. Without the participation of the gram sabha, there should not be any change in the land use pattern,” they demanded.

Declaring their intention to intensify their stir to press their demand for repeal of the Land Acquisition Act 1894, the farmers and NGOs said the Act was being used as a “weapon” to dispossess farmers of their ancestral land and their future generations of their livelihoods. “The Act is not deliberately being repealed so that as much acquisition as is possible is done before coming up with an alternative legislation,” alleged Pushpesh Verma, Bhupinder Singh Rawat, Brijender Singh, Sudhesh Pal Singh and others.

Addressing a joint press conference here, they deplored the misuse of the law to grab their land for building luxury homes, car racing tracks, golf courses etc. They did not want an amended bill “that favoured corporates and builders,” but demanded a comprehensive law that merged rehabilitation and resettlement with land-use plan as suggested by the NAPM.

Will not sell land

The farmers clearly said that they were not interested in selling their land. But if it came to that, then they should be paid the prevailing market rate at the time of payment, not what was at the time of notification of acquisition. Also, they reiterated their demand for a share in the developed asset.

“Not only are farmers dispossessed but, unskilled and illiterate as a majority [of them] are, they are deprived of their only occupation — farming. In these days of price rise and inflation, one-fourth of the farmers whose lands have been taken are on the verge of hunger. What kind of public purpose is this?” they asked.

Involve people

NAPM's Madhuresh said that people's movements had been struggling for a comprehensive law that involved people in decision-making. They had also given a draft Bill to the National Advisory Council and also shared their draft with the Rural development Ministry. “It was we — Medha Patkar, Aruna Roy and others — who first demanded that the rehabilitation and resettlement be merged with a Development Planning Bill.”

Quoting a research, he said between 1947 and 2001, 60 million people had been displaced and dispossessed in the country. Of them, only 17 per cent had been rehabilitated and resettled.
