No new Bill on quota in posts and services: Centre by J Venkatesan

The Department of Personnel and Training has made it clear that at present there is no proposal to introduce in Parliament a new Bill, viz SC/ST (Reservation in Posts and Services), though the earlier Bill introduced in the Rajya Sabha in 2008 was later withdrawn.

The DoPT stated this in reply to a query raised by Dr. B.R. Ambedkar Vichar Manch general secretary R.L. Kain whether the government would come out with a new Bill as per the assurance given during the 2009 Lok Sabha polls.

Mr. Kain, in his letter, pointed out that in 2004 the Common Minimum Programme of the government stipulated that a comprehensive Reservation law would be enacted to codify all reservations. This law would provide statutory force to the reservation policy, which had hitherto been implemented through executive instructions.

He said such a law would inspire confidence among members of the SC/ST and the OBC community and their legitimate aspirations for adequate representation in the national mainstream had been given protection by Parliament.

Though the government introduced such a Bill in 2004, it was referred to a Parliamentary Standing Committee, which wanted the Bill to be withdrawn and another Bill, only for SC/ST, to be introduced and it should be included in the Ninth Schedule of the Constitution to keep it beyond judicial review.

Again, another Bill was introduced in the Rajya Sabha in 2008 and it was passed without any discussion amidst noisy scenes. However, before its introduction in the Lok Sabha, the government withdrew the Bill as it contained certain lacuna. Even as the Bill was proposed, the government sought comments on the proposal to bring out a Compendium on Reservation for SC/ST and OBCs, but no such compendium was released.
