Noida land takeover: Court notice to UP on plea for CBI probe

The Allahabad High Court on Monday issued notices to the Centre, UP government, Greater Noida and Noida authorities and the Yamuna Expressway Development Industrial Authority (YEIDA) on a petition demanding a CBI probe into land acquisitions in Noida and Greater Noida from 2005 to 2010.

Asking them to file counter-affidavits in two weeks, the court said it would examine the maintainability of the petition on the next date of hearing. The notices were issued by a division bench comprising acting Chief Justice Amitava Lala and Justice Surendra Singh.

In his petition, Inderjeet Singh Nagar, an advocate and resident of Dadri in Greater Noida, claimed that authorities resorted to illegal use of Section 17 (1) of the Land Acquisition Act of 1894, commonly referred to as urgency clause, to acquire land.

“This was in violation of rules and regulations as landowners were not heard before their land was taken away,” said advocate Pawan Bhardwaj who, along with advocate Pramod Bhardwaj, argued on behalf of the petitioner.

He said the government acquired the land in the name of planned industrial development but gave it away to private property developers for other commercial purposes.

“We prayed before the court that wherever land was acquired misusing provisions under Section 17 (1) should be investigated by the CBI,” Bhardwaj said.

Earlier, counsels for the state and Noida and Greater Noida authorities argued that the petition was not maintainable as the petitioner had a vested interest.

“Our argument was that the petitioner’s father was already one of the petitioners challenging land acquisition in Patwari village. Hence, the petitioner becomes an interested party,” said Ramendra Pratap Singh, counsel for Noida and Greater Noida authorities.
