Number of judges in high courts to go up by 25% -A Subramani

CHENNAI: The number of judges in high courts across the country is set to increase by about 25%, with the Centre writing to all chief justices and chief ministers informing them of the decision and seeking their views on additional infrastructure and support staff.

As per a demi-official letter from union law minister Kapil Sibal dated January 16, the number of judges in the Allahabad high court will soon touch the 200-mark, while the strength in the Bombay high court will be just six short of the century-mark.

The Allahabad high court has 160 judges, and the strength is being increased go 200, though the Centre feels it should have 204 judges. In the case of the Bombay high court, the number is going up from 75 to 94. the Punjab and Haryana high court will become the third largest high court with the enhanced judge strength of 85 from the current 68. Judge strength at the Madras high court will go up to 75, from the present 60, the letter said, adding that Delhi's strength will go up to 60 from its current 48. Calcutta will have 73 judges instead of the present 58.

"We undertake periodic review of judges' strength for every high court to facilitate expeditious disposal of cases, taking into account the existing backlog and expected filing of cases," Sibal said in his letter.

Referring to a resolution adopted at the April 7, 2013 conference of chief justices and chief ministers, he said: "As per the decision, we have computed 25% increase of existing strength of judges for each high court. The Chief Justice of India has been consulted in the matter, and he is agreeable to the same as an interim measure."

Sibal's letter informed the chief justices that the chief minister concerned too had been informed about the decision.

The main purpose of the January 16 letter was to ask the chief justices to prepare proposals on additional facilities concerning courtroom, quarters and support staff for the enhanced number of judges. Noting that these facilities have to be put in place by the state government concerned, Sibal said the governments must give concurrence for them as well as make budgetary provisions.

As far as the Madras high court is concerned, Sibal's letter told Chief Justice R K Agrawal that of the 75 judges, 56 would occupy permanent vacancies while 19 would be additional judges. "The approved strength of judges in the Madras high court is proposed to be enhanced from 60 to 75. The permanent and additional judges would be bifurcated in the 75:25 ratio. Consequently, the strength of permanent and additional judges for your high court would be 56 and 19, respectively," the law minister's letter read.
