Prior sanction shouldn’t be needed to prosecute any class of bureaucrats under any law, the parliamentary panel on the Lokpal bill has said in its report, which Team Anna dubbed a bid to “fool” people for ignoring its key demands.

Another significant recommendation in the report, which was submitted today, is that the Central Vigilance Commission (CVC) look into complaints of corruption against Group C & D employees alone.

On including the Prime Minister under the proposed ombudsman, another key demand of Team Anna, the panel left it to Parliament.

A host of other demands made by the activist were rejected. These included bringing the judiciary and the lower bureaucracy under the Lokpal and merging the CBI. It also did not agree with calls that the Citizen’s Charter mechanism should be under the Lokpal, or that its scope should cover MPs’ conduct in the House.

Anna Hazare alleged the report had been drawn up at Rahul Gandhi’s behest, and announced a protest fast on Sunday in Delhi. “The issues (that the committee failed to address) remain the same. This means the standing committee has fooled the public. Their report does not help in fighting corruption,” he said.

Told that the dissent-ridden report had dismayed Team Anna, panel chairman Abhishek Singhvi said: “The job was not to please any individual or group or rubber-stamp any draft. We do not need any certificate from anyone.”

The committee felt the Lokpal would have to cover around 65 lakh persons if all central employees are added to the purview of the Lokpal, a number that would be unmanageable. If only Group A&B employees are set aside for Lokpal, the number will come down sharply to 7.75 lakh.

Hazare didn’t agree. “The CVC is under the government, it will do what the government says.”

The committee proposed that the Lokpal selection panel should include the Prime Minister, Lok Sabha Speaker, leader of Opposition, Chief Justice of India and an eminent citizen jointly selected by the constitutional bodies of the chief election commissioner, the CAG and the UPSC chairman. The search panel will have 50 per cent representation for SCs/STs, OBCs and minorities.

BJP unhappy

The BJP dubbed the draft report of the Lokpal bill complicated and a “lawyer’s document”, perhaps alluding to Singhvi who is a practising lawyer, and alleged that it “further undermined the credibility of a government that is already weak”.

Leaders of the BJP are likely to attend Hazare’s protest on Sunday, as are those of the Left.
