Pathribal Encounter: 'Witnesses Will Get Fresh Notices'

Fresh notices will be issued to eye-witnesses of the Pathribal fake encounter killing to appear for recording their statements in General Court Martial proceedings at Nagrota-based 16 Corps headquarters, army said tonight.

"Fresh summons giving reasonable time to the witnesses to report for recording of summary of evidence will be issued so that they can appear for recording evidence in a reasonable time frame," an army spokesman said.

Reacting to media reports of late receipt of summons by the families of civilians killed in the Pathribal encounter case, the army spokesman stated that the army reiterates its commitment to a fair and transparent trial.

He stated that so far the witnesses had not approached the army for any assistance, and added that the army is willing to provide necessary assistance to the witnesses at Nagrota in case the need arises.

On September 20, the army has commenced disciplinary proceedings at the 16 Corps headquarters against its five officers allegedly involved in the Pathribal fake encounter in which five innocent men were killed in Anantnag district in March, 2000.

The army's decision came after the Supreme Court on May 1 gave eight-week time to it to decide whether the accused officers will be tried in the GCM or face trial in a civilian court.

Lt Gen A S Nandal, outgoing GOC 16 Corps, heard the charges submitted by the CBI against the officers and directed Summary of Evidence to be recorded against them on September 20.

Brigadier Ajay Saxena, Lt Col Brajendra Pratap Singh, Major Sourabh Sharma, Major Amit Saxena and Subedar Idrees Khan were charge sheeted by the CBI in 2006 for killing five civilians and later dubbing them as foreign militants.
