The Supreme Court today refrained from passing any order on a plea for early listing of a PIL that had sought closure of pharmaceutical giant Ranbaxy, recently penalised by US authorities for allegedly supplying adulterated and substandard drugs.

The public interest petition sought registration of criminal cases under the penal code and also the Drugs and Cosmetics Act, 1947, against company officials for allegedly cheating millions of patients in the country.

The US Food and Drug Administration had earlier fined the company to the tune of over Rs 2,200 crore.

Justices Gyan Sudha Misra and Madan B. Lokur had initially listed the matter for hearing next week but later asked petitioner Manoharlal Sharma to mention it afresh on Thursday or Friday after completing a technical requirement. The PIL did not contain a "diary number". Every petition filed in the apex court needs to have a diary number to indicate that it had been cleared by the registry.

The PIL said the company "knowingly sold substandard drugs around the world, including in India, Africa and USA while working to deceive regulators".

The petition said although Ranbaxy had admitted its "guilt" before the US drug administration and agreed to pay $500 million in damages, Indian authorities had made no effort to haul up the company for selling adulterated medicines in the country for the past five years.
