PUCL demands repealing of the anti-farmer legislations

In its recent press release dated 4th December, 2020, People's Union for Civil Liberties (PUCL) has condemned the newly enacted Farm Laws of the Centre i.e. The Farmers’ Produce Trade and Commerce (Promotion And Facilitation) Act, 2020, better known as the APMC Act; The Farmers (Empowerment And Protection) Agreement on Price Assurance and Farm Services Act, 2020, better known as the Contract Farming Act; and The Essential Commodities (Amendment) Act, 2020.

PUCL has stated that the Centre has violated the principles of federalism by enacting the farm laws without consulting the states and the farmers.


Access to justice is being denied by the newly enacted farm laws, according to the press release by PUCL dated 4th December, 2020.

Section 13 of The Farmers’ Produce Trade and Commerce (Promotion And Facilitation) Act, 2020, very clearly mentions that "No suit, prosecution or other legal proceedings shall lie against the Central Government or the State Government, or any officer of the Central Government or the State Government or any other person in respect of anything which is in good faith done or intended to be done under this Act or of any rules or orders made thereunder." And Section 15 of The Farmers’ Produce Trade and Commerce (Promotion And Facilitation) Act, 2020, goes on to add that "No civil court shall have jurisdiction to entertain any suit or proceedings in respectof any matter, the cognizance of which can be taken and disposed of by any authority empowered by or under this Act or the rules made thereunder," thus handing redressal to the SDM level officer.

Similarly, Section 18 of The Farmers (Empowerment & Protection) Agreement of Price Assurance and Farm Services Act, 2020, states that "No suit, prosecution or other legal proceeding shall lie against the Central Government, the State Government, the Registration Authority, the Sub-Divisional Authority, the Appellate Authority or any other person for anything which is in good faith done or intended to be done under the provisions of this Act or any rule made thereunder." Along with that, Section 19 of The Farmers (Empowerment & Protection) Agreement of Price Assurance and Farm Services Bill, 2020 states that "No civil court shall have jurisdiction to entertain any suit or proceedings in respect of any dispute which a Sub-Divisional Authority or the Appellate Authority is empowered  by or under this Act to decide and no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any power conferred by or under this Act or any rules made thereunder."
