Wednesday's Supreme Court decision which upheld Allahabad High Court's order quashing acquisition of land by UP government at Shahberi village in Noida has come as a shot in the arm of the farmers agitating across the state against forcible land acquisition. While Opposition parties used it to sharpen their attack on the Maya government, farmer organisations said it's a warning to the Centre and state governments against the loot of the land in the name of development and to amend the colonial Land Acquisition Act 1894. It has also provided farmers a remedy which they can use to save their land. The Allahabad High Court had cancelled acquisition of 157 hectare land in Shahberi village last month on the petition of the farmers. The land was acquired using emergency clause without giving an opportunity to farmers to lodge their objections. At the time of acquisition, it was said that the land will be used for industrial purpose but within 11 days the land use was changed to residential. The state government paid farmers Rs 850 per square metre for the land but sold it to builders at whooping Rs 10,000 per square metre. The builders were reaping huge profits by developing township on the land. The apex court's decision to uphold high court's order has emboldened the spirits of farmers fighting against land acquisition in Greater Noida, Noida, Ghaziabad, Moradabad, Sonbhadra, Lucknow and other places. Farmers at these places have also decided to approach the court in case their land is acquired forcibly. The severity of problem can be gauged from the fact that 15 people have lost their lives in six bloody clashes between police and farmers over land acquisition in UP since 2007. The Act was made by the British to grab private land in the name of `public purpose'. The same continued after independence. Maya government is not the only culprit. Since 1991, all successive governments have acquired land in Noida and Greater Noida under emergency clause. The total land acquired comes out to be around 15,000 hectare. SP and RLD had come under fire in 2004-07 for 25,000 acre of land acquired in Dadri for a power plant to be set up by the Reliance Anil Ambani group. "Politicians raise hue and cry over land acquisition when in Opposition but none of them want to lose the power of acquiring land when they form the government because it is a great `source of earning'," said Mahendra Singh, a farmer leader. Sudhir Kumar, president, Kisan Jagriti Manch, said that the land mark Supreme Court decision has made it clear that state governments should keep away from acquiring land for commercial gains and at the same time directed the Centre government to amend the archaic Land Acquisition Act 1894 which gives extraordinary powers to the government to acquire land in the name of public utility. Another important aspect, he said, of the turn of events is the fighting spirit of the farmers who using non-violent means protested on the streets and took legal course to pin down the mighty and autocratic government. VM Singh, farmer leader, said that Maya government should treat the Supreme Court order as a precedent and return land to farmers acquired against their will in other parts of the state. Congress general secretary Digvijay Singh said that the order has exposed how Mayawati government is looting farmers. He demanded inquiry into the all land acquisitions in UP after 1990 when Congress lost power in the state. BJP state president SP Shahi and SP state leaders have also described Supreme Court order as a victory of farmers and have demanded resignation of chief minister Mayawati on moral grounds.
