Revised National Sports Development Bill: All sports bodies to come under ambit of RTI

Sports Minister Ajay Maken on Monday unveiled a revised National Sports Development Bill that retains the contentious provisions on age limits and tenures of heads of sports bodies, but introduces an exclusion clause to protect certain information while bringing sports federations within the ambit of Right to Information Act. 

"We strongly feel the functioning of the sports federations should be transparent. If they oppose it then there is something wrong," Maken told newspersons while unveiling the new sports Bill. He said the Bill would enhance greater transparency in the functioning of sports federations. 

According to Maken, all sporting bodies will be in the ambit of the RTI with an exclusion clause provided to protect certain information. An exclusion clause has also been inserted in the Right to Information Act (RTI) to protect certain information pertaining to selection and appointment of athletes and coaches, performance of an athlete and relating to health, fitness and doping issues. 

"Efforts have been made to streamline the Bill while retaining basic principles of transparency, good governance and de-control from government. Serious consideration has been given to remove the perception that the ministry was seeking to directly interfere in sports. So, I am hopeful that the revised Bill will get Cabinet's approval," Maken said. 

When the Bill was presented to the Cabinet last month, Union Agriculture Minister Sharad Pawar, who is also the current ICC chief and a former BCCI boss, and his colleagues Farooq Abdullah and Praful Patel had strongly objected to certain provisions, including those related to doping, age and tenure limitations. 

Maken said he was hopeful of getting the revised Bill cleared by the Cabinet though the sticky issues, including those pertaining to age and tenure limitations still remain. 

"We have sent the revised Bill to and all recognised National Sports Federations to send their comments/suggestions within two weeks," he added. 

Maken said that unlike other countries, the news of Indian sportspersons' medical health and fitness is in the public domain which is a disadvantage to the players. Since the BCCI has come under NADA, the sports minister said the Sports Bill will allow the BCCI to follow the same policy that is followed internationally. 

Questioning the age and norms tenure, Maken said, "We have age and tenure norms as we said earlier. It is something which forms a part of universal rules of good governance." 

"When 70 years is the age norm for International Olympic Council, their office bearers can't be more than that so why should our office bearers be more than 70?" he asked. The revised Bill has also capped the tenure of sports bodies at three terms. The question now is if Maken will make any headway with his Cabinet colleagues, many of whom wear a BCCI hat as well. "They have brought some changes, let the legal committee of BCCI go through it then we will be responding to that," BCCI vice-president Rajiv Shukla said.
