RTI activists seek Maharashtra information commissioner’s ouster by Dinesh Thite

Right to information (RTI) activists in the city have demanded the state government to invoke section 17 (3) (e) of the RTI Act, 2005, to remove Ramanand Tiwari from the post of state information commissioner (SIC), as his son owns a flat in the controversial Adarsh Housing Society in Mumbai.

President of Nagrik Chetna Manch, Maj Gen (retd) SCN Jatar, president of Sajag Nagrik Manch, Vivek Velankar, Surajya Sangharsh Samiti chief Vijay Kumbhar and convenor of Wings India, Vihar Durve, have sent a letter to chief minister Prithviraj Chavan in this regard.

They stated that Tiwari is not ready to quit his post for his alleged involvement in the housing society scam. However, the state governor has powers under section 17 (3) (e) of RTI Act, 2005 which states, “The governor may by order remove from office the state information commissioner if s/he has acquired such financial or other interest as is likely to affect prejudicially his function as SIC.”

They alleged that Tiwari has such interest in Adarsh case where in any second appeal pertaining to this case comes before him for hearing, his function as information commissioner can get prejudicially affected.

“We request you to recommend to the governor to use his powers and remove Ramanand Tiwari from the post of SIC,” they stated in the letter.

When the Adarsh file was processed, Tiwari was urban development secretary. He, along with state human rights commissioner, Subhash Lala, was asked to resign, but they refused to oblige.

“The state government has asked these senior officials to step down but they haven’t resigned,” said chief secretary SA Dange.

Highly-placed sources said the government had issued only oral orders to the two. Since the posts they hold are constitutional positions, certain rules have to be followed before taking action.
