Henceforth if any government agency denies information under Right to Information Act (RTI), applicants need not wait for years for the intervention of the state information commission. Instead they can approach the district consumer disputes redressal forum. In a land mark judgment, II additional district consumer disputes redressal forum, of the city of Seshadripu ram has ruled that RTI applicants are also consumers and it is the responsibility of the concerned agency to provide information on time. Or else applicants can approach the forum and seek a solution. Mr. G.Gajendra, a resident of Halasuru in the city, had filed an RTI application with Mr. Bhagavan, asst. executive engineer (Shivajinagar), BBMP, seeking documents showing asphalting of Purusotham Road, BBMP ward No.90, Halasuru from January 1, 2000 to July 28, 2011. He also had requested the BBMP to give the road history register and the document showing the permission granted for road cutting and laying the UGD and Cauvery Water Pipeline by BWSSB on the road. But the BBMP officer failed to provide the documents within the stipulated period. Applicant Mr. G. Gajendra approached the forum, saying there had been gross deficiency of service on the part of the BBMP officer Mr. Bhagavan and requested the forum to direct Mr. Bhagavan to provide the information and grant a compensation of Rs.5000. Forum president H V Ramachandra Rao and member Mr.Balakrishna V Masali observed that the petitioner had availed of the services of the said act by paying fees and had information under the Right to Information Act which was not supplied to the petitioner. This amounted to deficiency of service and there had been gross negligence on the part of the BBMP officer Mr. Bhagavan, despite receipt of the application and payment of the requisite fee under the RTI Act. Forum directed the BBMP to provide the required information to the complainant within 45 days from the date of the order and pay `2000 to the petitioner towards the cost of the litigation. Bhanuprakash H.R., a civil activist, said this order would help the RTI applicants. "Presently if any officer or agency denies information, applicant can approach the state information commission. The Commission takes at least six months to list the case for hearing. But henceforth applicants can get justice easily," he added.
