RTI rules amendment not to deny info: State

Mumbai: The amended Maharashtra Right to Information (RTI) Rules have not been issued for curtailing the freedom of expression of citizens or to harass them, the state government told the Bombay High Court on Thursday.

The government stand, stated in an affidavit, came in response to a public interest litigation challenging restrictions pertaining to word limit and of limiting one application for information to one subject. The affidavit was filed by Rashid Gafur Sayyed, joint secretary, General Administration Department.

The petitioner, Solapur-based Shivaji Kshirsagar, contends that the rules go against the objectives of the central RTI Act and will only serve to cause harrassment of citizens and “to deprive citizens from seeking information within time as well as in reasonable costs.”

The affidavit states, “The amendment Rule 3(A) specifically mentions that if an applicant wishes to seek information on more than one subject matter, he shall make seperate applications. It is thus clear that there is no denial of information to any applicant.”

It claims that Maharashtra receives the highest number of RTI applications and speaks of two categories of applicants — activists and persons filing applications for their personal reasons. It adds that the information sought by the former category is often on a very large scale.

On the amendment stipulating a word limit, the official has pointed that the relevant section only says that the application “shall not ordinarily exceed 150 words.” He further states, “It is thus clear that there is no prohibition on an application with more than 150 words.”

Earlier, the bench of Justices D D Sinha and V K Tahilramani, which is hearing the matter, had orally observed that the amendment does not seem to restrict information, and that a person can always file multiple applications if information is required on several subjects. The case is slated to be heard on September 7.
