SC faults Centre, states on NREGS implementation

The Supreme Court on Thursday rapped the Union and state governments for their failure to discharge their duties under the National Rural Employment Guarantee Act ( NREGA) aimed at providing "right to livelihood" to millions of poor in the hinterlands.

Noting the disbursal of Rs 33,506 crore out of the total available fund of Rs 42,529 crore for 2009-10, a Bench comprising Chief Justice S H Kapadia and Justices K S Radhakrishnan and Swatanter Kumar raised serious doubts about money reaching the needy without being diverted or misappropriated.

Its fears were confirmed by additional solicitor general Indira Jaising, who said NREGA schemes were gasping for breath when it came to implementation because of resistance from states for scrutiny of utilisation of funds through the laid down procedure. The bench said NREGA clearly placed "right to livelihood" at a higher perch than a mere legal right. "In the affidavits filed by the Union of India as well as the states, the allegations in regard to irregularities, diversion of funds, improper maintenance of records and non-implementation of schemes have been denied," the bench said.
