SC frowns on prefix to Babri demolition

There is nothing famous or infamous about the Babri Masjid demolition, the Supreme Court said today after a government lawyer described the case as “famous”.

“What is famous about it? It was an incident which happened and (the) parties are before us. It is not famous or infamous,” Justices H.L. Dattu and C.K. Prasad said.

The two-judge bench was hearing a CBI petition to allow criminal conspiracy charges to be revived against senior BJP leader L.K. Advani, Shiv Sena chief Bal Thackeray and 19 others.

At the beginning of the proceedings, the additional solicitor-general declared that the matter was related to the “famous” Babri demolition case, prompting the court rejoinder.

The proceedings could not go on as some of the parties to the case had not filed their responses. The hearing was adjourned till March 27.

On March 4 last year, the apex court had issued notices to 21 people, including Advani, Thackeray, Kalyan Singh, Uma Bharti, Murli Manohar Joshi, Vinay Katiyar, Sadhvi Ritambhara and several Vishwa Hindu Parishad leaders and monks.

The court had asked all of them to file their responses on why criminal conspiracy charges should not be revived against them.

It had passed the order on a CBI appeal against a May 2010 Allahabad High Court judgment upholding a trial court decision of May 2001 to drop the criminal conspiracy charges. The high court had allowed the CBI to proceed with other charges against the accused in a Rae Bareli court.

The CBI appeal said: “It appears an artificial distinction was made by the trial court attempting to assign a role in respect of each of the accused persons and to see which offences were made out.”

It added: “The order passed by the high court results in serious miscarriage of justice... and also disables an effective trial.”
