SC issues notice to UP and MP on irregularities in MGNREGS by Soibam Rocky Singh

The Supreme Court Monday issued notice to states of Uttar Pradesh and Madhya Pradesh on the issue of alleged misappropriation of funds by officials and functionaries administering the MGNREGS.

The order of the Apex Court came in response to reports of the Comptroller and Auditor General (CAG) and National Institute of Rural Development (NIRD) alleging large scale misappropriation of funds by the officials and functionaries of the implementing agencies.

During the hearing, advocate Prashant Bhushan appearing for Centre for Environment and Food Security pointed out that Central Bureau of Investigation (CBI) can investigate the matter taking into account the reports of CAG and NIRD. Bhushan argued that the nature of irregularities are multifold, and until all these are classified and sorted out, the investigation would not be complete.

The Bench of Chief Justice of India HS Kapadia, Juctice KS Panicker and Justice Swatanter Kumar responding to Bhushan’s suggestion directed CBI to take up the investigation taking into account the CAG and NIRD report.

It may be remembered that the Orissa government had on March 22 issued notification for a CBI probe into the matter for six districts in the state.

Additional Solicitor General Indira Jaisingh appearing in the case asked for increase in the numbers of districts to be investigated by CBI from six to twenty two in Orissa. She also submitted before the Bench a letter from the Director of CBI asking for assistance from Orissa Government and Ministry of Rural Development in probing the matter.

During the hearing Prashant Bhushan also pointed out concerns over non-implementation of guidelines issued by the Central Government. Indira Jaisingh in reply responded that the guidelines have been issued to the states but it has not been implemented by many states.

The Bench said, “We are not governing the country. You cannot say states are not applying to our directions. We cannot go on giving direction on all matter.”
