SC mandates quota for poor kids under RTE by Dhananjay Mahapatra

This order will bind all private unaided schools in Rajasthan, but it underlined the Supreme Court's anxiety towards implementation of Right To Education Act, 2009, which mandated schools to keep 25% of seats for socially and economically disadvantaged sections.

Importantly, a Bench comprising Justices R V Raveendran and A K Patnaik also stayed the stipulation of weightage to parent's educational qualification for admissions into pre-primary and nursery classes. Though this is an interim order from the SC concerning the appeal filed by Society for Unaided Private Schools of Rajasthan, the salutary effect of it could encompass schools across the country, especially in Delhi where parents face a harrowing time during nursery admissions.

The Rajasthan High Court, while acting on a PIL filed by advocate Muneesh Kumar Sharma, had in 2007 directed schools to follow the point system for admission of children into nursery and pre-primary classes. The HC had also directed that there should not be any written tests or interviews of children or their parents by the school management. This was challenged in the apex court by the society. During a hearing on the society's appeal, standing counsel for the state Manish Singhvi pointed out that the 2009 Act providing free and compulsory education to children had come into effect from April 2010. In view of this, private schools could not have a free run, he argued.

The SC asked the schools to implement the 2009 Act strictly for admissions to the 2011-12 academic year. It said the interim order would be subject to the final outcome of the writ petitions filed by the society and other private schools challenging the validity of the 2009 Act.
