New Delhi: The Supreme Court on Friday directed the Centre and nine states, including Bengal, to file affidavits within four weeks stating by when they would fill their vacant posts of information commissioners and, in some cases, even chief information commissioners.

The bench of Justices A.K. Sikri and Ashok Bhushan were hearing a petition from RTI activist Anjali Bharadwaj, who cited four vacancies in the Central Information Commission and many in the nine states.

Bharadwaj, represented by advocate Prashant Bhushan, said four more vacancies would arise in the central agency, including that of the chief information commissioner, by year-end.

Activists have alleged that Bengal has just two information commissioners who are hearing appeals and complaints filed 10 years ago. The other states under the scanner are Karnataka, Telangana, Nagaland, Odisha, Kerala, Maharashtra, Gujarat and Andhra Pradesh.

"(The) Union of India also has to explain why the posts in CIC have remained vacant even though the advertisement to hire more members was issued in 2016," the bench said.

Bhushan complained that after the matter was listed, the Centre had put out an advertisement on Friday morning inviting applications for the vacant posts. "At least they are doing something," the court quipped.
