SC warns Haryana against repeat of Mirchpur attack

Taking a serious view of recent arson against Balmiki community by upper caste men in Mirchpur in Haryana, the Supreme Court on Wednesday issued a warning to the Bhupinder Singh Hooda government: serious consequences will follow if atrocities against dalits are reported again.

Directing the Hisar district administration to build new houses in place of damaged ones of dalits in the village and provide one member of each family with work under NREGA or any other scheme, a vacation Bench comprising Justices G S Singhvi and C K Prasad told the dalits that the social issue could be resolved by sitting across the table with upper castes.

The Bench, however, said violence had no place in the country where rule of law prevailed and where the state was bound to protect citizens. It also asked deputy commissioner of Hisar, Yudhvir Singh, to visit Panchkuian Road area in New Delhi to verify the claim that 150 families, who fled the village after the incident, had taken shelter there.

Before winding up the hearing and posting further proceedings on July 19, the Bench sounded a warning, "No further incident of atrocities on dalits should occur. If it occurs and if the state is found lacking in any manner, serious consequences will follow."

This means the Hooda government will have to rein in Khap panchayats which hold kangaroo courts to unleash punishment on those who cross the rigid social line drawn by them.

The Bench also asked Haryana advocate general H S Hooda and additional advocate general Manjit Singh Dalal to depute two advocates as an independent fact-finding committee to the village as well as to Panchkuian Road to ascertain the ground situation and report back to the court. Both the DC and the advocates' committee were asked to submit reports to the court within four weeks.

On behalf of the victims, senior advocate Colin Gonsalves said the villagers were living in fear and were refusing to return to Mirchpur given the total social and economic boycott slapped on them by the Khap panchayat.

He said the Khap panchayat had on May 9 agreed to lift the boycott if the victims withdrew all criminal cases lodged after the April 21 incident, in which a 70-year-old man and his 18-year-old physically challenged daughter were burnt alive.

Gonsalves said a mahapanchayat was called for June 15 and the victims feared that they would be forced to agree to the demands. This was denied by the advocate general who said there was complete peace in the area and there was no threat to the Balmiki community.

He said Rs 20 lakh had been paid to the kin of the dead and adequate compensation had already been given to the injured and those whose houses were damaged.
