The Delhi High Court on Wednesday reserved its verdict on a plea against imposition of prohibitory orders in and around India Gate during the recent anti-rape stir, saying the legal provision of Section 144 of CrPC may lose its sanctity if invoked without proper procedures.

“There are rights to movement and speech and expression, it (Section 144 of the CrPC) cannot be used just like that...otherwise it would lead to loss of the sanctity,” a bench of Chief Justice D Murugesan and Justice V K Jain said.

Constable death: Plea in HC for CBI probe

A plea calling for a CBI probe into the death of Constable Subhash Tomar was filed in the Delhi High Court on Wednesday. The constable died of a cardiac arrest, reportedly brought on by injuries sustained during violent protests against gangrape of the 23-year-old student. The petition, which is likely to come up for hearing on January 4 before a bench headed by Chief Justice D Murugesan, sought the probe alleging contradictions in statements of Delhi Police Commissioner Neeraj Kumar, eyewitnesses and the medical expert.
