Settlement of FRA issues to delay Posco land acquisition further

The views of the Union Ministry of Environment and Forest (MoEF) panel on violation of Forest Right Act in the Posco project site area is likely to further delay the land acquisition process and precipitate the problems for the South Korean steel major which has been facing uphill task in acquiring land for the project due to local protests.

The MoEF panel visited the Posco project site villages yesterday and interacted with the villagers on implementation of the provisions of Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 in the area.

The mandate of the panel was to see if there was any violation in observing the norms regarding complete process of identification and settlement of rights under Forest Rights Act (FRA) for the entire forest area proposed for diversion, getting the consent of tribal people or traditional slum dwellers through Gram Sabha and diversions of forest land for facilities managed by the government as required by section 3 (2) under FRA. After interaction and field visit in Dhinkia, Ashish Kothari, a member of the committee, informed that there are no Scheduled Tribes in the area identified for the Posco project, but FRA was not implemented and consent of forest dwellers was not taken by convening palli sabha or gram sabha though the villagers have been depending on forest land for their livelihood since 1930.

Stating that the district administration should not go for resurvey of the site and take any steps for land acquisition for the project at present, he said, the panel will urge MoEF to ensure that the land acquisition in the Posco site is stopped till the completion of the process for implementation of FRA. Besides, sources said, the advice of the committee to the villagers to submit fresh applications within three months to stake claim to their rights under FRA will also delay the land acquisition process as it will take one to two years to settle these claims. A forest official said, "Identification and settlement of rights of forest dwellers in the entire forest area for diversion of forest land is very important and land acquisition without their identification will violate FRA. The process will take a long time affecting the land acquisition for the Posco project’

Panchayat samiti member of Gadkujang, Basudev Behera said, the Central team has advised the villagers of Noliashai under Gadkujang panchyat to claim their rights under FRA and the villagers have now decided to intensify their stir against the survey and land acquisition for the project after being aware about their rights".

However, contrary to the views of the MoEF panel, the district administration has decided to conduct resurvey of the Posco site from July 27. It has decided to take help of Global Positioning System (GPS) to remove large number of irregularities in the last survey and made elaborate for proper identification and demolition of betel vines to facilitate land acquisition for the project. Four joint survey teams have been formed by the administration to expedite the resurvey work.
