Sex abuse panel must in all firms: Draft Bill by Himanshi Dhawan

Companies that do not set up a sexual harassment complaints committee within their organization can be penalized under sweeping provisions proposed in a draft Bill to check sexual abuse at the workplace.

The Bill, cleared by the law ministry and expected to be discussed in the Cabinet by mid-July, also seeks to make false complaints of sexual harassment punishable under service rules.

In an effort to cover every working woman under the proposed law, the ministry for women and child development headed by Krishna Tirath has included the unorganized sector in the Bill.

The Bill seeks to make it mandatory for an employer to constitute an internal committee in which most members are women. If an internal committee cannot be set up or the complaint is against the employer himself, the aggrieved woman can approach a local committee set up by the government under a district officer.

If harassment is proved, a penalty will be levied keeping in view the victim’s mental suffering, income and financial status, medical expenses incurred by her and loss of career opportunity. The Bill also prohibits publication or making contents of the inquiry or the aggrieved woman’s details available.
