Sexual harassment bill hits cabinet wall

Amendments to a bill meant to check sexual harassment of women in the workplace failed to get the Union cabinet’s nod today as several ministers frowned on certain provisions.

Sources said the Sexual Harassment of women in the Workplace (Prevention, Prohibition and Redress) Bill was referred to a group of ministers headed by Union home minister P. Chidambaram. Human resource development minister Kapil Sibal and woman and child development minister Krishna Tirath are the other members of the group.

The bill proposes to bring domestic workers within its ambit and is expected to provide speedy redress to about 47.5 lakh women registered as household help in cases of sexual harassment.

Sources said the main objection of the ministers was that the bill was loaded in favour of the complainant and the burden of proving innocence was on the employer, which could encourage false complaints. Chidambaram, Sharad Pawar, Sibal and a few others advocated caution on this provision.

A senior minister said: “Some more discussion is needed on the bill. You cannot have it completely one-sided.”

The bill provides protection to women who enter a workplace as clients, customers, apprentices or day labourers, or in ad-hoc capacities. Students, research scholars and patients in hospitals have also been covered under the bill.

The woman and child development ministry has not accepted a standing committee’s recommendation to bring male workers within the ambit of the bill.

Child sex abuse

The cabinet today approved amendments to a bill under which any sexual activity, even consensual, with a person below the age of 18 would be considered an offence.

In the earlier version of the Protection of Children from Sexual Offences Bill, 2011, consensual sex with someone above 16 was not considered a crime.
