Sexual Offences: CPM favours death penalty, CPI wants life -Nidhi Sharma

CPM, which has conventionally opposed capital punishment, has suggested enhancement of punishment in sexual offences and proposed life imprisonment and even death in rarest of rare cases. 

In the final draft of suggestions being sent to Justice Verma Committee, formed by the government to rewrite the country's rape laws after the horrific gang-rape, the Left party has openly called for capital punishment in rare and brutal cases. According to sources, CPM has suggested that crimes be differentiated as per severity, such as ordinary, with aggression and aggression leading to death of the victim. The party says the punishment should be enhanced with maximum sentence of life imprisonment for sexual offences done with aggression. In rarest of rare cases, similar to the horrific gang-rape, the party has proposed capital punishment. 

Despite the public outrage over the December 16 gang-rape, the Left parties had opposed capital punishment and had instead focused on Delhi Police's inability at preventing such crimes against women. Senior Left leaders had said hanging the accused would not correct the wrongs within our system. Traditionally, the Left has opposed death penalty as it feels that it can be misused by the state. However, Buddhadeb government in West Bengal had advocated death penalty for convictDhananjay Chatterjee, who was accused of raping and murdering a minor girl. While CPM has suggested capital punishment, CPI has proposed life imprisonment extending to the entire life of the rapist. A senior CPI leader said, "Though the protesters have been demanding capital punishment, we feel that nobody has the right to take the life of a person. Not even the state." 

CPM has also pushed for expediting the trials in sexual offences. It has suggested a time-frame of six months to complete the trial and punish the guilty. The Left party has also called for respecting the privacy and emotions of the victim and has suggested that the trial should be in-camera. A senior CPM leader told ET , "We also want that the entire rape case should be monitored from the first stage by a committee. This panel should be involved in overseeing the filing of FIR, getting medical examination of victim, investigation of case, filing of chargesheet and the final disposal of the case." CPM was engaged in closed-door meetings on Thursday and may send the final draft of suggestions to Justice Verma Committee on Friday. 

The three-member committee has been tasked with submitting its report within 30 days. The committee has sought views from the public and political parties till January 5. The report will be tabled in Parliament along with the government's action-taken report in the budget session in February.
