SIT refuses to submit Naroda Patiya report in special court by Manas Dasgupta

“Will be submitted to appropriate magisterial court”

The Supreme Court-appointed Special Investigation Team on Wednesday refused to submit its report to the special court hearing the Naroda Patiya massacre case, just as it had informed the special court trying the Gulberg Society massacre case on Tuesday.

The SIT told the special court that it would submit its report to an “appropriate magisterial court” as directed by the Supreme Court.

Supreme Court order

The Supreme Court in its September 12 order had asked “the Chairman, SIT, to forward a final report, along with the entire material collected by the SIT, to the court which had taken cognisance of the Crime Report”.

The apex court had also stated that before submission of its report, it will be open to the SIT to obtain from the amicus curiae copies of his reports submitted to this court.

It said the court will deal with the matter in accordance with the law relating to the trial of the accused, named in the report/charge sheet.

“Wrongly interpreting”

The SIT is now expected to submit its reports before the Ahmedabad Metropolitan Magistrate Court, where the first charge sheets of the massacre cases were filed.

The next hearing of the Naroda Patiya special court has been fixed for November 24.

Demand a time-limit

While the advocate of the much talked about Gulberg Society massacre case victims, S.M. Vora, had claimed that the SIT was “wrongly interpreting” the Supreme Court's order and would challenge its decision not to submit the report before the special court, the advocate for the Naroda Patiya massacre victims, Mukul Sinha, said that at the next hearing that he would demand a time-limit for the SIT to submit its report before the metropolitan magistrate's court to prevent an indefinite delay in the proceedings of the special courts.
