SLP against land acquisition for Nano dismissed by J Venkatesan

The Supreme Court on Monday declined to interfere with a Gujarat High Court judgment dismissing a petition which challenged land acquisition by the State government for the Tata Motors’ Nano project at Surendranagar.

Rejecting the public interest litigation petition filed by the NGO, Rashtriya Kisan Dal represented by H.K. Thaker, Chief Justice of India K.G. Balakrishnan asked him: “You don’t want industrialisation of Surendranagar? Gujarat is the second most industrialised State.”

When Mr. Thaker, who argued himself, alleged that around 1,100 acres of fertile agricultural land belonging to 4,000 farmers had been given to Tata Motors at Rs. 410 crore by the government, Justice B.S. Chauhan asked him: “How have you come to the court? Do you know whether people, whose land has been acquired, have been awarded compensation or not? The High Court has also questioned your bona fides.”

The CJI, however, told Mr. Thaker: “We are not questioning your bona fides. We are rejecting your petition.”

The NGO said the government, instead of acquiring fertile land, should have allotted barren land to the company at either Dwarka, Kutch or Surendranagar. Also, “Providing loan and other benefits of about Rs.17,440 crore by the government to the company is misuse of public money. It would lead to loss of income to the government.”

Mr. Thaker alleged that thousands of farmers had become landless and jobless.
