Names 7 from mob that burnt to death his father, step-sister

Mirchpur victim Tara Chand's son Amar Lal who was called to depose as a court witness by the Sessions court here hearing the Mirchpur caste violence case on Thursday named seven members of the Jat community who he said were part of a mob of 300-400 people from Mirchpur village in neighbouring Haryana that burnt to death his father and step-sister Suman on April 21, 2010. Eighteen Dalit homes were also burnt down in the incident.

Amar Lal was not called in to depose as witness by either the prosecution or the defence although the defence had earlier listed him as one of its witnesses. Additional Sessions Judge Kamini Lau in her order on June 10 had observed that records available with the court revealed that Tara Chand had stated in his dying declaration that his son was aware of the names of the assailants.

“The prosecution has not examined Amar Lal since he is stated to have been won over. Defence has not examined him. In view of the dying declaration of Tara Chand, Amar Lal is a material witness whose testimony before the court is relevant for a just decision of the case,” the June 10 order stated.

However, belying the fears of the prosecution, Amar Lal, 25, in his testimony broadly concurred with the deposition by other prosecution witnesses. He also alluded to the role played by Narnaud Station House Officer Vinod Kumar Kajal who asked villagers from both communities to gather at thechaupalto sort out tensions that began on April 19 and continued to fester.

Amar Lal said very few from the dominant community came for the peace talks, but on returning found their Balmikibastiwas surrounded from all sides by a mob allegedly armed with lathis, bricks and stones.

He said his father and step-sister took refuge in their house but a few members of the mob poured oil through the windows of their house and a neighbouring house and that a fire was started, after which Tara Chand ran out of the house. He was forced back inside and the door bolted from outside by a mob member, Amar alleged, pointing out that he was watching from a safe distance.

Amar Lal did not give a clear answer on the possible reason for tensions developing between the two communities. During cross-examination, he was questioned pointedly by defence counsel on why he had not named any of the assailants before Thursday, though as many as five of his statements had been recorded.

Defence counsel also suggested that his last statement on July 25, 2010, in which he named the Narnaud SHO followed political pressure. Earlier, Tara Chand's second wife Kamla had identified 81 of the 98 accused in the case.

On Thursday, Dr. Lau directed both defence and prosecution to submit a written memorandum of arguments so that arguments can begin on a day-to-day basis from next week.
