Stop misuse of red beacons or we will pass order: SC -Dhananjay Mahapatra

NEW DELHI: The Supreme Court on Monday sounded the last warning to the Centre saying if it failed to enforce the law and stop rampant misuse of red beacons, sirens and multi-tone horns within two weeks, it would pass an order for its strict implementation.

"A small section of society does not bother about the law. Your law permits a very small number to use red beacons. Stop its misuse by anyone and everyone. Remove all sirens and multi-tone horns from all vehicles. If you do not tell us the mechanism to stop it, then we will pass orders," a bench of Justices G S Singhvi and V Gopala Gowda said.

Giving two weeks to solicitor general Mohan Parasaran and additional solicitor general Siddharth Luthra to consult authorities for immediate implementation of rules and regulations under the Central Motor Vehicles Act, the bench posted the matter for further hearing on August 19. Parasaran and Luthra agreed with the bench that beacons and sirens were being misused in blatant violation of rules.

The bench was for imposition of "heavy and exemplary" fine on red beacon flashing vehicles which weave through traffic by blaring sirens and threatening commoners. "Except for those permitted to use red beacons, strip all other vehicles of it. Somewhere it must stop. These are a menace to society," it said.

When Parasaran talked about fines of Rs 500 for first offence and doubling it for subsequent offences, the bench said it would not do. It said in some countries, throwing a small piece of paper on the road attracted $100 or $200 fine. "If we want to end the menace of vehicles flashing red beacons and blaring sirens, then the fines have to be very heavy and enforced with rigour," the bench said.

Parasaran said the modalities to implement the law restricting the use of red beacons and sirens to a select few constitutional authorities would soon be implemented to end what the court referred to as a menace. "We will put an end to it," the SG assured.

The court clarified that police, ambulances, fire tenders and Army vehicles part of unit movement would be exempted from the rules.

At present, the rules permit the following dignitaries to use red beacon with flasher on top of the vehicle while on duty anywhere in the country: President, vice-president, prime minister, former presidents, deputy PM, Chief Justice of India, Speaker of the Lok Sabha, Union Cabinet ministers, deputy chairman Planning Commission, former PMs, leaders of opposition in Rajya Sabha and Lok Sabha and judges of the Supreme Court.
