New Delhi: The Congress student wing has publicly criticised the passage of the juvenile justice amendment act and promised to take the matter up with the parent party, which helped pass the bill last week.

Under the amended act, now waiting for presidential assent, juveniles aged 16 to 18 can be tried as adults for heinous crimes, a provision children's rights activists have condemned as draconian.

"We are against the passage of the JJ Act with this provision as it can potentially send children to prison. The judiciary should be reformative," National Students Union of India president Roji M. John said.

"We will take the issue up with the party (Congress) and convey to them that laws cannot be made on the basis of emotions and Parliament cannot play to the gallery on such issues."

The students plan to issue a public statement tomorrow against the bill's passage.

The bill cleared the Rajya Sabha last Tuesday - with the CPM alone walking out in protest - when several Opposition parties that had advised further scrutiny did not press their case.

Its passage came amid a public campaign in the bill's favour at a time the juvenile convict in the fatal gang rape of December 2012 had been released on completion of his three-year detention while his adult accomplices waited on death row.

The Congress, the amendment bill's original architect, wanted it referred to a select committee but apparently yielded to "public pressure" at the last minute, unwilling to be seen as blocking a law aimed at protecting women.

Members of its student arm are, however, upset at what they see as a capitulation.

"Ours is a democratic party and we have our opinions. Let me tell you, there are leaders within the Congress who I'm sure were against the provision," John said.

The first signs of the discontent had appeared yesterday when the student body's secretary, Angellica Aribam, posted a series of tweets.

"We, the @nsui, are deeply perturbed by the passage of the amendments in the Juvenile Justice Bill, 2014 earlier this week in Rajya Sabha," she tweeted.

"We feel that the govt is denying the 16-18-year-old children of this country the slim chance that a juvenile justice system would give them - That is a chance to salvage their lives and become responsible and productive citizens. Vengeance-driven blood lust is not the answer."

Aribam argued that the act violated international and domestic norms relating to child rights.
