Forest Bench says statutory clearance is a must
 
The Forest Bench of the Supreme Court on Friday made it clear that no iron ore mining operations in Karnataka shall be permitted to resume unless there was statutory clearance for mining and till reclamation and rehabilitation was implemented in full.

The Bench, comprising Justice Aftab Alam, Justice K.S. Radhakrishnan and Justice Swatanter Kumar, took the decision after the Central Empowered Committee in its August 16 report said “no further direction is required regarding sale of iron ore and/or resumption of mining operations by Category A mining leases.”

The report said that “the CEC does not agree with the contention of the Karnataka Iron and Steel Manufacturers Association that the resumption of the mining operations in Category A mining leases may be permitted without insisting on them having all the statutory approvals.

The report said that “the CEC will continue to monitor and closely interact with Karnataka government, the Ministries and statutory authorities concerned and others so as to ensure preparation and implementation of R and R (reclamation and rehabilitation) plans without delay and availability of iron ore to the steel and allied industries.”

The Bench told counsel for the parties” “You don't press for resumption of mining activities unless we are sure that there is a statutory compliance. No mining activities will resume unless R and R measures are fully implemented, and all statutory compliance should be there.”

The Bench, while accepting the CEC report, directed it (CEC) to consider the submissions of counsel Prashant Bhushan, appearing for Samaj Parivartan Samudaya, an NGO, that he would be giving by Monday, and the CEC should give a comprehensive report on that aspect. This came after Mr. Bhushan submitted that even those leases kept in Category A (because they have not encroached) had committed other serious illegalities and had caused serious environmental damage. He said that many of them were in forest areas.”

The Bench directed that matters be listed on August 23 to consider the CEC report of April 27 that recommended CBI investigation of theft of iron ore from the Belekere port. The Lokayukta of Karnataka had also found theft and bribery at Belekere port.

Appearing for Karnataka Iron and Steel Manufacturers Association, senior counsel C.S. Vaidyanathan stated that the iron and steel units in Karnataka had come to the brink of closure as a result of shortage in the supply of iron ore.

He sought directions for opening of Category A mines and to NMDC to produce one MMT of iron ore per month, as earlier directed by the court so that a continuous source of iron ore was assured to the domestic steel industry.

Arvind P. Datar, senior advocate appearing for NMDC, stated that there was no difficulty for the corporation to produce the required quantity of iron ore every month, but there were bottlenecks in transportation due to shortage of rakes.
