Alleged involvement of Rajya Sabha Deputy Chairman P.J. Kurien

KOTTAYAM: The victim in the Suryanelli sex-scandal case and those close to her are considering taking legal recourse seeking further investigation into the alleged involvement of Rajya Sabha Deputy Chairman P.J. Kurien in the case.

Those close to the victim say they have two options before them, one being to approach the court at Munnar, where the original case was registered, invoking relevant clauses of the Code of Criminal Procedure (Cr.PC), and the other to file a writ in the High Court seeking further investigation into the case, invoking Article 226 and citing Clause 482 of the Cr.PC.

A final decision will be taken within two days, legal advisers to the girl said.

Following the annulment of the verdict of the Kerala High Court in the case early this month, the victim wanted to know if there was scope for further investigation into the private complaint she had filed in the First Class Judicial Magistrate Court, Peerumade, on March 15, 1999. The court had summoned Mr. Kurien, but he filed a Criminal Miscellaneous Complaint in the Kerala High Court seeking to quash the complaint. The court did not allow it, and Mr. Kurien then moved the Supreme Court which asked him to file a discharge petition in the lower court. This time, the Kerala High Court disposed of the case. The Special Leave Petition filed against the High Court order in the Supreme Court was also not granted.

The victim’s demand for further investigation got a fillip recently with ‘fresh evidence’ coming from various sources. The most important one is that from the third accused in the case, S. Dharmarajan, from his hideout in Karnataka, who had claimed that he took Mr. Kurien to Kumily on the fateful day. With Dharmarajan in police custody, the victims and her friends believe there is scope for further investigation into the case.

“Our case has not been heard so far, and fresh evidence is cropping up. It is against this backdrop that she had sought the possibility of further investigation,” her father had said recently.
